What NR-12 Is, in One Sentence

NR-12 (“Norma Regulamentadora 12 — Segurança no Trabalho em Máquinas e Equipamentos”) is Brazil’s mandatory occupational safety regulation for machinery, issued by the Ministry of Labour. It plays the same functional role in Brazil that the OSHA machine guarding standards play in the US, that the EU Machinery Directive (2006/42/EC, replaced by 2023/1230) plays in Ireland and the Netherlands, and that the WHS Regulations plus AS 4024 play in Australia.

The key technical fact: NR-12’s risk assessment methodology is based on ABNT NBR ISO 12100 — the Brazilian adoption of the exact same ISO 12100 standard used across the EU, and referenced by AS 4024 in Australia. If your home country already works with ISO 12100 or EN ISO 12100, the underlying engineering logic in Brazil is the same. What changes is the legal packaging: mandatory registration with a licensed engineer, formal documentation, and enforcement by labour auditors.

Where NR-12 Is Stricter Than What US Visitors May Expect

Unlike OSHA — where machine safety compliance is largely employer self-managed with inspections triggered by complaints or incidents — NR-12 requires:

  • A documented Risk Assessment (Apreciação de Risco) for every machine, or for the machine set when equipment operates as an integrated line;
  • Sign-off by a licensed mechanical/safety engineer (CREA registration), who is personally liable — civilly and criminally — for the technical accuracy of the report;
  • A formal compliance report (laudo técnico) plus an ART (Anotação de Responsabilidade Técnica), which functions similarly to a professional engineer’s stamp in US/Canadian practice, but is mandatory rather than optional for this category of work.

Where It Looks Familiar to EU and Australian Readers

If your company already complies with the EU Machinery Directive (relevant for Irish and Dutch operations) or with AS 4024 (Australia), the technical vocabulary will feel familiar: hazard identification, risk estimation, protective measures hierarchy, interlocking, emergency stop circuits, and machine-set (integrated line) assessment are all handled the same way conceptually. The difference is procedural: Brazil requires the assessment to be tied to a specific liable professional and registered through a formal report, rather than embedded in a CE technical file.

Why This Matters for Foreign-Owned Operations in Brazil

Multinational plants operating in Brazil (chemical, automotive, food, mining, and industrial equipment sectors) are subject to NR-12 regardless of what standard the parent company follows at headquarters. A CE-marked machine imported into Brazil, or a machine already compliant with OSHA guarding rules, still requires a Brazil-specific NR-12 Risk Assessment and compliance report — international certification does not substitute for it.
